Limited Product Warranty
This limited warranty is your exclusive remedy against Remy Battery Co., Inc. PLEASE READ THIS PROVISION CAREFULLY. BY PLACING AN ORDER WITH US, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH HEREIN.
1. The Limited Warranty covers the specific product and the original purchaser against any proven defects in materials or workmanship from the date of purchase for a period of six (6) months to the original purchaser. Such defects will be repaired or replaced at Remy Battery Co., Inc.’s option; there will be no charge for parts or labor related directly to the defect.
2. Warranty Limitations: The warranty does not cover the cost for removal or reinstallation, or to any product or part thereof which has suffered through normal wear and tear, alteration, improper installation, physical abuse, misuse, neglect, or accident. Nor does it cover defects caused by repair or service of the enclosed product by anyone other than a Remy Battery Co., Inc. authorized service center; or resulting from acts of God, including but not limited to fire, flood, earthquake, and other natural disaster, will be excluded. WE MAKE NO OTHER EXPRESS WARRANTY INCLUDING ANY WARRANTY OF MERCHANTABILITY OF THE PRODUCT OR ITS FITNESS FOR ANY SPECIAL PURPOSE. WE ARE NOT LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES INCLUDING WITHOUT LIMITATIONS, ANY DAMAGES OR LOSSES CAUSED BY OR RELATED TO INCOMPLETE OR INTERRUPTED SERVICE OF THE PRODUCT. ALL IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THE SIX (6) MONTH TERM OF THIS EXPRESS WARRANTY. YOU AGREE THAT THIS IS OUR ONLY WARRANTY AND WE HAVE GIVEN YOU NO OTHER WARRANTY FOR THE PRODUCT.
3. Repair Service: To obtain repairs or replacement within the terms of this warranty, the product should be delivered with proof of purchase, transportation prepaid, to Remy Battery Co., Inc. For assistance please call 800-455-7400 or 414-384-0340.
4. State Law: Some states do not allow the exclusion or the limitation of consequential or incidental damages, or a limitation on the duration of implied warranties, so the above limitations or exclusions may not apply to you. This limited warranty gives you specific legal rights and you may also have other rights, which may vary from state to state.
5. Mandatory Arbitration: All Disputes and controversies of any kind arising out of or in connection with this limited warranty, whether relating to construction, validity, meaning, performance or non-performance thereof, shall be submitted to and finally settled by Arbitration. Any such arbitration shall take place in Milwaukee, Wisconsin, and be governed by the rules of the American Arbitration Association.
6. Choice of Law: All Disputes and controversies of any kind arising out of or in connection with this limited warranty, whether relating to construction, validity, meaning, performance, non-performance or any other legal or equitable claim shall be exclusively governed by the laws of the state of Wisconsin.
